VISA CONSULTATION

 

Visa Consultation Unit is responsible for the tasks with which the Head of Office for Foreigners has been charged under Art. 33, 34, 46 of Act on Aliens of 13 June 2003 (Journal of Law 06.234.1694 with later amendments) in conjunction with Art. 22 of the Regulation of the European Parliament and of the Council of 13 July 2009 establishing Community Code on Visas (visa code).

What is meant by the visa consultations is an exchange of information between Schengen Member States and national Consulted Authorities on  third-country nationals applying for a visa that allows for an entry into or travel through the Schengen Area. This information is transmitted under Art. 33.1 of Act on Aliens for the purpose of conducting checks on whether a person applying for a Schengen or national visa is not considered a threat to a national defense or security, public order and safety or to the national interests of Republic of Poland and whether the purpose and conditions of intended stay have been justified. Under the above-mentioned Act, such information about persons applying for a Schengen visa may be transmitted to all Member States and to Commander in Chief of  the Border Guard, Commander in Chief of the Police, Head of Internal Security Agency, Head of Intelligence Agency and minister responsible for foreign affairs. Data on persons applying for a national visa is consulted only by the domestic Consulted Authorities. In cases that do not require subsequent checks, visa consultations should end within ten days, respecting a 15-day deadline within which a visa authority has to reach a decision on an application.

Furthermore, Head of Office for Foreigners transmits to and receives from Member States information on issued Schengen visas due to Art. 31 of the visa code.
