Legal Basis: Article 69(1) of the Act on Foreigners of 13 June 2003 (Dz.U. of 2006, No. 234 item 1694, as amended).
A foreigner's residence permit for EC long-term resident is revoked if:
1) the residence permit for EC long-term resident was granted in breach of law;
2) it is a real and serious threat to state defence or security, or the protection of public security and order;
3) they have left the territory of the Republic of Poland for a period longer than 6 years;
4) they have left the territory of the European Union for a period of consecutive 12 months;
5) they have obtained a residence permit for EC long-term resident within the territory of another Member State of the European Union.
RE-OBTAINING A RESIDENCE PERMIT FOR EC LONG-TERM RESIDENT
In case when a residence permit for EC long-term resident has been revoked due to reasons referred to in Article 69(1)(3)-(5) of the Act on Foreigners, the next residence permit for EC long-term resident is granted when the foreigner meets the conditions specified in Article 65, with the proviso that prior to submitting an application for the issue of another permit they should have legally and uninterruptedly stayed within the territory of the Republic of Poland for at least 3 years.
