Provisional identity certificate of the alien

   

The authority that has received the application issues the applicant and his/her spouse, on behalf of whom the applicant submitted the application, a provisional identity certificate that is valid for 30 days.

When the validity of first identity certificate has expired, the successive identity certificates may be issued to an alien, for the periods of validity not exceeding 6 months until the completion of the proceedings for granting the refugee status. 

The personal data of a child, on behalf of whom the applicant submitted the application, are entered into the identity certificate of the child's parents. After the expiry of the first identity certificate The Head of the Office may, at the request of one of the parents, issue a separate identity certificate for a minor child of more that 7 years, on behalf of whom the applicant submitted the application. 

If the applicant is an unaccompanied minor, the identity certificate is issued to the minor's name. 

A valid identity certificate confirms the identity of the person, to the name of whom it has been issued and it entitles that person as well as all minor children entered into the certificate to the stay on the territory of the Republic of Poland. 

An alien who received an identity certificate is obliged to replace it in case of:

1) change of the data contained therein;

2) birth of a child;

3) expiration of its validity;

4) damage of the identity document, which makes its use difficult;

5) other circumstances, which make confirming his/her identity difficult;

The identity documents shall be issued in place of the lost ones or replaced by the President of the Office. The first identity certificate is issued ex officio.  Successive identity certificates are issued and replaced upon the request of the alien submitted on an appropriate form. Photographs shall be enclosed to the application.

An alien who has lost his/her identity certificate shall report this fact to the Head of the Office within the time limit of 3 days from the date of the loss.  If the lost identity certificate has been found and if the alien has been issued a new identity certificate, he/she is obliged to return the found one immediately.

A alien who has received the final decision on granting the refugee status is obliged to immediately return the identity certificate to the authority of its issue.  If the alien, who received the final decision on the refugee status, leaves the territory of the Republic of Poland, he/she shall return the identity certificate to the commanding officer of the Border Guard checkpoint at the moment of crossing the border.
