Mode and rules governing the submitting of applications for the refugee status

 

Proceedings connected with granting the refugee status are initiated upon the application of an alien referred to as the ‘applicant.' The application must be submitted on an appropriate form.

The applicant submits the application for the refugee status on behalf of his/her minor children on the condition that they are not married and he/she supports them. The proceedings in respect of granting the refugee status also cover the child of the applicant born in the period from initiating the proceedings until it is ended with a final decision.

The applicant may submit an application for granting the refugee status on behalf of his/her spouse he/she supports as well as minor children of the spouse who are not married upon the written consent of the spouse. Consent of the spouse to submit an application in his/her name shall be treated as granting the applicant with power of attorney, also to act on behalf of the spouse's children. If the spouse withdraws his/her consent to submitting the application on his/her behalf, the proceedings in respect of granting the refugee status to the spouse and his/her children are discontinued.

The application is to be submitted to the Head of the Office for Foreigners through the competent commanding officer of the Border Guard Division or the commanding officer of the Border Guard checkpoint. The application must be submitted in person by the applicant and the person on behalf of whom the applicant acts.
