Interrogation

 

The body conducting the proceedings interrogates the applicant in order to establish facts essential to making the decision and provides him/her with a copy of the protocol.

The applicant shall not be interrogated if the decision on granting the refugee status may be issued solely on the basis of evidence gathered or if the applicant is unable to participate in the interrogation or may nor appear for the interrogation because of the state of his/her health or for psychological reasons or when the application is considered as obviously groundless (if the applicant stated that the reasons behind submitting the application were different than fear of persecution because of race, religion, nationality, political views or membership in a specific social group or risk of being harmed or if he/she has not given any information on the circumstances connected with the fear of persecution or risk of being seriously harmed) unless the applicant is an unaccompanied minor.

The interrogation takes place without the presence of the person on behalf of whom the applicant acts unless the body conducting the proceedings deems his/her presence necessary to clarify the case.

Should a need arise, the body conducting the proceedings provides free help of an interpreter in command of the language of the applicant during the interrogation.

The body conducting the proceedings may record the interrogation using a device that registers image or sound if the applicant has been informed of that fact and it is possible from the technical point of view.
