Impermissible applications
If the body conducting the proceedings finds the given application impermissible it shall issue a decision on discontinuing the proceedings due to the impermissible character of the application.
An application is deemed impermissible when:
1) The applicant was granted the refugee status in another Member State;
2) After receiving a final decision denying the refugee status the applicant has submitted a new application on the same basis;
3) A spouse that previously consented to submitting an application by the applicant on his/her behalf has issued another application while there are no circumstances concerning the spouse that would justify the application.
