INVITATION

 

 

Legal basis

Article 16, Article 17, Article 18 of the Act of 13 June 2003 on foreigners (Dz. U. of 2006, No. 234, item 1694, as amended).

Authority registering the invitation in the register of invitations and issuing a decision to refuse registration or cancel the invitation

 

Voivode competent with respect to a place of residence or the seat of the inviting party registers an invitation in the register of invitations or issues a decision to refuse registration or to cancel the invitation.

Inviting party

Registration of invitations for foreigners takes place on request of the inviting party, through an entry in the register of invitations.

The invitation may be issued by:

  • 1) a Polish citizen residing in the Polish territory, a citizen of an EU Member State, Member State of the European Free Trade Association (EFTA) - parties to the agreement on the European Economic Area or the Swiss Confederation, and a member of his family, living on Polish territory and having a right of residence or permanent residence in that territory;

  2)  foreigner residing, immediately before issuing the invitation, legally and continuously for at least 5 years on Polish territory, or authorized to settle in Poland or having a residence permit for EC long-term resident;

  3)  legal person or organizational unit without legal personality, established in the Polish territory.   

 

The invitation shall include:

  1)  data on the inviting party:

a)  first name(s), last name, date and place of birth, citizenship, address, phone number, type, series and number of identity document or

b) company or name, REGON number, address and telephone number of a legal person or entity without legal personality;

  2)  first name(s), last name, date and place of birth, gender, nationality, address, series and number of travel document of invited foreigner and the degree of relationship with the inviting party;

  3)  first name(s), last name, date of birth and sex of the spouse and children of the invited foreigner, if they are invited;

  4)  commitment of the inviting party to cover costs associated with the stay of the foreigner, including the cost of accommodation and possible treatment, the cost of return to the country of origin or residence or the cost of transit to a third country, which provides entry, and the cost of expulsion from the territory of the Republic of Poland;

4a)  address of accommodation of invited foreigner;

  5)  determination of the time for which the foreigner is invited;

5a)  determination of the purpose of stay of the invited foreigner;

  6)  name of the authority which made the entry into the register of invitations;

  7)  date and number of the entry to the register of invitations;

  8)  signature of the inviting party.

 

Documents:

 

The inviting party applying for entry into the register of invitations submits:

  • 1) a completed application form for entering the invitation into the register of invitations;
  • 2) document confirming the possibility of covering the costs associated with the stay of the foreigner, including the cost of accommodation and possible treatment, the cost of return to the country of origin or residence or the cost of transit to a third country, which provides entry, and the cost of expulsion from the territory of the Republic of Poland;
  • 3) a document confirming legal title for the apartment, if the accommodation for the invited foreigner is the apartment of the inviting party or a document confirming the possibility of providing accommodation to the foreigner in another place;
  • 4) proof of payment of stamp duty.

 

Appeal procedure

 

The party dissatisfied with the decision of first instance authority shall have the right to apply, within the statutory period of 14 days from the date of notification of the decision, against the decision to the authority of a higher degree, which for the above mentioned cases is the Head of the Office for Foreigners.  In turn, the party can lodge a complaint to the administrative court against the decision of the authority of second instance, through this authority, within 30 days of notification of the decision, and the court exercises judicial review of the performance of public administration in terms of compliance with the law.

 

Validity of the invitation

Invitation becomes effective when it is entered, at the request of the inviting party, into the register of invitations, and is valid for one year.

 

 

Stamp duty

 

A stamp duty of PLN 27 is collected for entering the invitation into the register of invitations.
