By virtue of law, initiating proceedings in respect of granting the refugee status results in:
1) Revoking a visa;
2) Expiry of the decision on the obligation to leave the territory of the Republic of Poland;
3) Withholding the execution of the decision on expulsion until the date the foreigner is served with a final decision on
granting the refugee status
- issued to the applicant and the person on behalf of whom the applicant acts.
During proceedings in respect of granting the refugee status:
1) Visas are not prolonged or issued;
2) Decisions on the obligation to leave the territory of the Republic of Poland are not issued;
3) Decisions on expulsion are not issued.
In case the applicant submits another application for granting the refugee status the execution of the expulsion decision shall not be withheld. It is also admissible to issue a decision on the obligation to leave the territory of the Republic of Poland or the decision on expulsion. The Head of the Office may withhold the execution of the decision of expulsion until the date when the applicant is served with the final decision on granting the refugee status if this serves the justified interest of the party, it is not contrary to social interest and submitting another application was not intended to delay issuing the decision on expulsion or delay or impede the execution of such decision.
The application for withholding the execution of an expulsion decision should encompass the justification of the justified interest of the applicant. The application should be submitted together with another application for granting the refugee status through the receiving body. In case the expulsion decision was issued after submitting another application for granting the refugee status, the application is submitted directly to the Head of the Office.
The decision on withholding the execution of the expulsion decision should be issued within five days since transmitting the relevant application by the receiving body or since receiving the application submitted directly to the Head of the Office. Party dissatisfied with the decision of the Head of the Office on withholding the expulsion decision may apply for re-examination of the case within five days since serving the decision.
The Head of the Office may change or revoke the decision on withholding the execution of the expulsion decision at any time in case the circumstances change.
The decision on withholding the execution of the expulsion decision expires by virtue of law on the date of serving the alien with the final decision on granting the refugee status initiated upon another application.
