ENTRY AND RESIDENCE IN THE TERRITORY OF THE REPUBLIC OF POLAND

 

A family member who is not an EU citizen may enter the territory of the Republic of Poland on the basis of a valid travel document and a visa (if it is required).

 

THE OBLIGATION TO HOLD A VISA DOES NOT APPLY TO:

1) a national of a state covered with a partial or complete exemption from visa requirement pusuant to the Council Regulation (EC) No 539/2001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement (OJ L 81, 21.3.2001, p. 1-7 ), amended by Council Regulation (EC) No 2414/2001 of 7 December 2001 amending Regulation (EC) No 539/2001 ( OJ L 327, 12.12.2001, p. 1-2 ) and by Council Regulation (EC) No 453/2003 of 6 March 2003 amending Regulation (EC) No 539/2001 ( OJ L 69, 13.3.2003, p. 10-11);


2) a family member who is not an EU citizen but holds a valid document issued by other Member State equivalent to a residence card of an EU citizen's family member or to a permanent residence card of an EU citizen's family member, referred to in Articles 30 and 54, or a valid residence card, issued pursuant to the Act of 13 June 2003 on foreigners.;

 

A VISA FOR JOINING AN EU CITIZEN

A family member who is not an EU citizen is granted a visa to allow him or her to join or accompany an EU Member State national.

 

 


REFUSAL TO GRANT A VISA TO A FAMILY MEMBER WHO IS NOT AN EU CITIZEN

A family member who is not an EU citizen may be refused to be granted a visa if:

  1) his or her data are entered in the register of foreigners whose stay in the territory of the Republic of Poland is undesirable; prepared pursuant to Article 124(4) of the Act of 13 June 2003 on foreigners, hereinafter referred to as "the Register", or

  2) his or her stay in the Republic of Poland may constitute a threat to state defense or security, protection of public security and order or public health.

 

REFUSAL OF ENTRY IN THE TERRITORY OF THE REPUBLIC OF POLAND

A family member who is not an EU citizen may be refused entry in the territory of the Republic of Poland, if:

  1) his/her data are in the Register or

  2) his or her stay in the Republic of Poland  may constitute a threat to state defense or security, protection of public security and order, public health or  3) does not hold a document referred to respectively in Article 9 (1) and (2) unless he or she otherwise proves, beyond any doubt, that he or she is entitled to benefit from a freedom of movement of persons.
