CONSEQUENCES OF SUBMISSION OF A REFUGEE STATUS APPLICATION

When a refugee status application is submitted:
  • the foreigner's visa becomes invalid,
  • the issued decision obliging the person to leave the territory of the Republic of Poland expires,
  • enforcement of the expulsion decision issued for the foreigner is suspended for the duration of the refugee status procedure.

In the course of the refugee status procedure:

  • a visa is not issued or extended,
  • decisions on the foreigner's obligation to leave the territory of the Republic of Poland are not issued,
  • expulsion decisions are not issued.

If the applicant submitted a new refugee status application, the enforcement of the expulsion decision is not automatically suspended. It is also acceptable to issue a decision on an obligation to leave the territory of the Republic of Poland or an expulsion decision. 

The Head of the Office for Foreigners may however suspend the enforcement of an expulsion decision, if this is motivated by a person's legitimate interest and is not contrary to social interest and the subsequent application was not issued in order to delay the expulsion decision or to interfere with the enforcement of such a decision. An application for the suspension of the enforcement of an expulsion decision should describe the reasons for the existence of the applicant's legitimate interest in suspending its enforcement. The application should be submitted along with the next refugee status application and this should be done through a receiving authority, but it should be submitted directly to the Head of the Office, if the expulsion decision was issued after another refugee status application was submitted.
