COMMUNICATION

 

We hereby inform you that on 24 May 2007, Sejm of the Republic of Poland adopted the Act amending the Act on Aliens and several other acts. The Act was published in Dziennik Ustaw [Journal of Laws] of 5 July 2007, No. 120 item 818.

This Act, in its Article 18, provides for the possibility to legalise the illegal stay of aliens in the Republic of Poland.

In order to qualify for the abolition, the alien must meet the following conditions:

  • 1) He/she must have been staying in the Republic of Poland continuously at least since January 1997;
  • 2) On the day of the entry into life of the Act, the stay in the Republic of Poland must be illegal;
  • 3) Within 6 months from the entry into life of the Act, he/she must apply for the residence permit for a specified period of time;
  • 4) He/she must point a living quarters in which he/she plans to reside, and present a legal title to occupying it;
  • 5) He/she must have a promissory note for issuance of the job permit in the Republic of Poland or a written statement by the employer on the intention to employ him/her or entrust him/her with another form of paid work, or on having a function in a management board of legal persons carrying out economic activities, if the job permit is not required, or has income or possessions sufficient for the coverage of maintenance costs of him/herself and dependent family members, including the costs of medical treatment, without the need to use social assistance financial support for the period of 1 year.

The stay of an alien in the Republic of Poland is deemed continuous if the alien has not left the territory of the Republic of Poland at least since 1 January 1997. If, however, breaks have occurred in the stay in this period of time, the duration of none of them can be longer than 6 months, and all of them together cannot be longer that 10 months.

The abolition concerns only those aliens that have not applied for residence permit for a specified period of time on the basis of abolition regulations introduced in 2003.

If the alien meets the above conditions, the Voivode competent for the place of residence of the alien shall grant residence permit for a specified period of time for one year, unless this could result in danger for defence capabilities or security of the state or for public safety and order, or in burden for the state budget, or violation of interests of the Republic of Poland.

The Act of 24 May 2007 amending the Act on Aliens and several other acts shall enter into force on 20 July 2007.
