Assistance for aliens applying for granting the refugee status

 

An applicant and a person represented by the applicant shall be provided with social assistance (granted in the centre or in a form of financial means for covering the costs of stay in the territory of the Republic of Poland) and medical care, as well as with assistance in any country he/she is authorised to enter.  This does not concern any persons provided with complementary protection or who have permit for tolerated stay, residence permit for a fixed period, permit to settle, a long-term resident's EC residence permit, as well as persons staying at the custodian-educational centres, aliens placed in guarded centres, the arrest with the purpose of expulsion or serving a sentence of deprivation of liberty. 

Social assistance and medical care are provided during the proceedings for granting a refugee status and for 2 months from the day on which the final decision on the refugee status is delivered, and in case of the discontinuance of the proceedings for 14 days from the day on which the final decision on the discontinuance of the proceedings is delivered.  If the Head of the Office is notified in writing about the alien's intention to voluntarily return to his country of origin, the period of granting social assistance and medical care to the alien is prolonged to the day on which the alien is scheduled to leave the territory of Poland in a way organized by the Head of the Office.

The placement of an alien in the centre is possible on the basis of a provisional identity certificate. An alien placed in the centre shall be obliged to observe the rules of stay in the centre. If the applicant or the person represented by the applicant behaves in a way that constitutes a threat to the safety, health or life of other aliens staying in the centre or the employees of the centre, he/she may be detained and placed in a guarded centre or in the arrest in the purpose of expulsion.  

The financial benefit for covering, on his/her own, the costs of stay in the territory of the Republic of Poland is granted on the basis of a decision by the Head of the Office upon the request of the alien or ex officio.

The detailed rules for granting, withdrawing and suspending the assistance for the aliens applying for granting the refugee status as well as the range of the assistance are stipulated in the provisions of the Act of 13th June 2003 on granting protection to aliens within the territory of the Republic of Poland.
